The following terms and conditions apply to all website development / design services provided by WILD APPLE DESIGN GROUP to the CLIENT.

Acceptance

It is not necessary for any CLIENT to have signed an acceptance of these terms and conditions for them to apply. If a CLIENT accepts a quote then the CLIENT will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.

Charges

Charges for services to be provided by WILD APPLE DESIGN GROUP are defined in the project quotation that the CLIENT receives either by e-mail or hardcopy. Quotations are valid for a period of 30 days. WILD APPLE DESIGN GROUP reserves the right to alter or decline to provide a quotation after expiry of the 30 days.

Unless agreed otherwise with the CLIENT, all website design services require an advance payment before the work is supplied to the CLIENT for review.  The exact deposit will be included in the project quotation and determined based on the scope and timeframe of work performed.

WILD APPLE DESIGN GROUP accepts the following credit cards VISA, MASTERCARD, DISCOVER and AMEX.  Credit cards payment can be made online from our secure online billing system or over the phone by calling 413.279.1677.  We also accept checks payable to WILD APPLE DESIGN GROUP and sent to 95 Post Office Park, Wilbraham, MA 01095.

Design Review & Acceptance

WILD APPLE DESIGN GROUP will provide the CLIENT with an opportunity to review the proposed design concepts. The exact number of proof concepts and revisions will be defined in the project quotation. Based on CLIENT signoff the proof concepts will be deemed accepted and scheduled to be coded.

Turnaround Time

WILD APPLE DESIGN GROUP will install and publicly post or supply the CLIENTs website by the date specified in the project proposal, or at date agreed with CLIENT upon unless a delay is specifically requested by the CLIENT and agreed by WILD APPLE DESIGN GROUP.

In order to facilitate the agreed completion date, the CLIENT must ensure content required for website development is provided to WILD APPLE DESIGN GROUP within the timeframe that has been agreed upon. This includes any required images, documents, data files or any other related digital content. If the timeline is likely to be prolonged WILD APPLE DESIGN GROUP will modify the projected timeline accordingly and both parties will be required to sign-off on the revised dates to avoid any misperception.

Failure to Provide Required Website Content

To remain efficient WILD APPLE DESIGN GROUP must ensure that work we have scheduled is carried out at the scheduled time. On occasions we may have to reschedule or even discard offers for other work to ensure we meet our project deadlines. On any occasion where progress cannot be made with your website because we have not been given the required information in the agreed time frame, and we are delayed as result, we reserve the right to impose a surcharge to revive your account.

If you agree to provide us with the required information and subsequently fail to do within (90 days) of project commencement we reserve the right to close the project and the balance remaining becomes payable immediately. Simply put, do not give us the go ahead to start until you are ready to do so.

Submitting Content

Text content should be delivered as a Microsoft Word, email, PDF (or similar) document with the pages in the supplied document representing the content of the relevant pages on your website. These pages should have the same titles as the agreed website pages. Contact us if you need clarification on this.

For larger files that are too large to email such as hi-res images, videos, audio files etc., WILD APPLE DESIGN GROUP is happy to make accommodations using popular cloud based services such as Google Drive, Dropbox or FTP.

*FAX documents or any other content that is not provided in a digital format may incur additional charges to reproduce non-digitized content into digital form.

Accuracy of Site Content

The CLIENT is responsible for typos or any other errors of any information that is provided to publish on the web site.  This also includes the scenario where WILD APPLE DESIGN GROUP is requested to harvest information from an existing web site and cut and paste into a new web site. Although we do our best to review any information that we transfer over our staff is not aware how accurate the information is unless specifically instructed by the CLIENT.

Web Browsers

WILD APPLE DESIGN GROUP makes every effort to ensure websites are designed using web standards defined by W3C to be viewed by the vast majority of visitors. Websites are designed to work with the most popular current browsers (e.g. Firefox, Internet Explorer 8 & 9, Google Chrome, Safari etc.,) CLIENT agrees that WILD APPLE DESIGN GROUP cannot guarantee correct functionality with all browser software across different operating systems including mobile and tablet handheld devices.

WILD APPLE DESIGN GROUP cannot accept responsibility for web pages which do not display acceptably in new versions of browsers released after the website have been designed and handed over to the CLIENT. As such, WILD APPLE DESIGN GROUP reserves the right to quote for any work involved in changing the website design or website code for it to work with updated browser software. 

Third Party Widgets / Add-ons

'Widgets' is a collective term used to describe a third party service which can be inserted into your web page (another popular term for the same service is Add-on's). WILD APPLE DESIGN GROUP uses numerous third party widgets for displaying slideshows, video etc., and majority of web sites that offer web services typically offer widgets to make it easy to insert content into a web page.

All the Widgets that WILD APPLE DESIGN GROUP uses are developed by third party developers as with any widgets provided by third party web service providers such as Facebook. Widgets typically include at least one layout by default; some provide additional themes, or another term commonly used is "skins" to change the appearance of the widget. If the client decides to use widgets the overall appearance will be determined by the available themes or skins. Requests to customize the appearance of a widget theme will be considered additional. 

Technology Assurance

The Technology Assurance Program (TAP) is a service level agreement (SLA) designed to maintain the content management software that powers your web site behind the scenes over a 12-month period. Throughout each year several updates to the core CMS and CMS Add-ons are released as new evolving technologies become available. Our service level agreement guarantees that your enterprise CMS will be automatically updated and permanently maintained and monitored for a fixed flat rate. Some examples include:

  • Security patches
  • Review of Add-on performance – replace any Add-ons that are no longer supported or depreciated
  • System Maintenance, database maintenance to ensure your site is always running at peak performance
  • Perform scheduled updates to core CMS or Add-ons, several updates are released throughout the year
  • New features are constantly added – this certifies your site is always up to date
Social Media Development

To enhance the user experience, social media sites such as Facebook does, from time to time, update their platform and occasionally those updates effect the layout / display of a customized design. Although we do everything we can to accommodate our customers when these changes occur, it is understood that we are not responsible for how these changes / updates affect the display of customized designs and may require a reasonable fee, as needed, to create the re-designed element(s).

Payment

Invoices will be provided by WILD APPLE DESIGN GROUP upon completion but before publishing the live website unless specific payment terms were established in project proposal. Invoices are normally sent via email by our online billing system to one or more recipients however, the CLIENT may choose to receive hard copy invoices. Invoices are due upon receipt. Accounts that remain unpaid thirty (45) days after the date of the invoice are subject to a service charge in the amount of one and one-half percent (1.5%) of the total amount due.

Additional Expenses

Examples of additional expenses include but are limited to the purchase of special fonts, stock photography, and setup of third party services that were not specified in the project proposal. This also includes additional changes and revisions to the design or tweaks to coding that go beyond the scope of the project proposal.

Termination

Termination of services by the CLIENT must be requested in a written notice via snail mail or email is adequate and will be effective on receipt of such notice. If the CLIENT is moving their web site to another provider a one-time service fee of $500 will apply in effort to package up your web site files, database, provide any additional account(s) credentials to third-party services, communications, and deactiving and packages all web services to provide to CLIENT.

For security purposes WILD APPLE DESIGN GROUP does not provide a self-service hosting control panel. The CLIENT is also responsible for planning the transition with new web host / developer. Upon request WILD APPLE DESIGN GROUP can aid with the migration of web services based on an hourly rate of $85/hour.

Ownership

The CLIENT maintains full ownership of the website and its content that is offered and supported by WILD APPLE DESIGN GROUP as well as related services such as domain names, or third party services that WILD APPLE DESIGN GROUP may assist in setting up on the CLIENTS behalf. In the event a CLIENT decides to terminate service with WILD APPLE DESIGN GROUP the CLIENT will be provided a full backup of all files and technology has been developed.
