Web Services Terms of Service (TOS)

WILD APPLE DESIGN GROUP provides web hosting services to clients worldwide. These Terms of Service (TOS) are intended to give you a clear and transparent understanding of your responsibilities while using our services. By using any WILD APPLE DESIGN GROUP service, you acknowledge and agree to abide by these Terms of Service, whether or not you have read them.


WILD APPLE DESIGN GROUP strives consistently and diligently with a team of engineers to maintain reliable, fast and secure hosting services. Customer acknowledges that occasionally services may be inaccessible or inoperable for various reasons, including periodic maintenance procedures or upgrades ("Scheduled Downtime"); or service malfunctions, and causes beyond our control or which are not reasonably foreseeable by WILD APPLE DESIGN GROUP, including the interruption or failure of telecommunications or digital transmission links, hostile network attacks, or network congestion or other failures. WILD APPLE DESIGN GROUP has no responsibility for downtime resulting from a user's actions or third party services that could impact customers website, some examples include but are not limited to services that rely on third party APIs, DNS services, CDNs, Domain Registration, and embedded third party scripts that can be added to web pages using our content management system. WILD APPLE DESIGN GROUP will provide at least 48 hours advance notice to customers for Scheduled Downtimes if they exceed 15 minutes. 


Web Hosting Payment
For your convenience your hosting services will auto rebill on an annual basis, other payment terms are available upon request. If you do not want your account to automatically billed, you must notify us before the date that the re-billing is due to take place. WILD APPLE DESIGN GROUP accepts checks and all major credit cards. Hosting plans will automatically renew until a plan is canceled.


Failure to Make Payment
WILD APPLE DESIGN GROUP may temporarily deny or terminate service upon the failure of the customer to pay the charges when due. Such termination or denial will not relieve the customer of responsibility for the payment of all accrued charges and any collection fees.


Suspended Accounts
Failure to make payment on hosted services may result in suspension (45 days thereafter of dated invoice) and archived for (90 Days). After 90 Days the customer account will be permanently removed from the WILD APPLE DESIGN GROUP network.


Reactivation
If an account is suspended a one-time reactivation fee of $35 will be applied.


Cancellation
You may cancel an account at any time by sending an email to [email protected]. The customer’s account will remain active until the end of the subscription. Any customer who follows standard procedures for canceling hosting is entitled to a hosting refund equivalent to the length of time that has been paid for, but not used. This refund is calculated based on a daily rate, depending on the hosting plan that was ordered.


Moving Website to a New Provider
The WILD APPLE DESIGN GROUP Breeze platform does not provide access to a self-service hosting control panel; however, customers can export their website directly as HTML files. Customers are responsible for managing the transition with their new web host or developer. In most cases, it is advisable to manually rebuild your website with the new provider—unless your ecommerce site was developed in Shopify and you own the account, in which case you are in control of the migration process.


If you require additional assistance, WILD APPLE DESIGN GROUP can support your web service migration, domain transfer, or provide consulting services at an hourly rate of $150. Please note that we do not provide support for websites that are not hosted within our server environment. Once a website has been transferred to the client or their new provider, all WILD APPLE DESIGN GROUP warranties and support are terminated.


Website Content
All services provided by WILD APPLE DESIGN GROUP are to be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or Local law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, material that jeopardizes national security, or material protected by trade secret or other laws. The subscriber agrees to insure and hold harmless WILD APPLE DESIGN GROUP from any claims resulting from the subscriber's use of WILD APPLE DESIGN GROUP services which damages the subscriber or any other party. Customer also claims responsibility for any photos/images they post on their website in particular stock art and intellectual property rights of third parties (e.g. trademark, patent or copyright infringements). The customer represents to WILD APPLE DESIGN GROUP and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to WILD APPLE DESIGN GROUP for inclusion. Pages are owned by the customers or that the customer has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend WILD APPLE DESIGN GROUP from any claim or suit arising from the use of such elements furnished by the customer. In short, don't publish artwork, content, or photographs that don't belong to you unless you have permission.

Offensive Behavior
Racist, intolerant, "hate" defamatory, "stalking", invitations to fight, threatening or any communication of any nature that we decide, in our sole discretion, as being improper, will result in service termination without prior notice.


Accepting Credit Cards Though Your Web Site
To comply with PCI standards, any business that accepts credit card payments online must use a secure payment gateway or trusted services such as Stripe.com or PayPal. Adhering to PCI standards not only safeguards your customers’ cardholder data and prevents theft, but is also a mandatory requirement for all merchants processing credit card transactions. Privacy Policy
Adding a Privacy Policy to your web site is required to meet today's strict PCI compliance. A Privacy Policy describes your privacy rights regarding the collection, use, storage, sharing and protection of your client's personal information that you collect from online transactions.


SSL Certificates
Every customer site includes an SSL certificate by default, which is activated across all pages—not just for store checkouts or login areas. SSL adds an essential layer of security and, according to Google, can also help your website’s pages rank better in search results.


Restrictions
WILD APPLE DESIGN GROUP websites are offered as a managed hosted platform. Our team takes care of the updates to our network and the core software and apps that power our customer websites. This configuration provides our team a level of quality control by only hosting technologies that we ourselves use or approve. We restrict the installation of third party software or plugins that could potentially impact security or performance. Dissimilar to the traditional hosting WILD APPLE DESIGN GROUP hosted services are not intended to be used or accommodate third party developers therefore the following services are prohibited.


  • Server Access, FTP, SSH
  • Installation of Third Party Software that is powered by our network 


Domain Registry
WILD APPLE DESIGN GROUP is partnered with ENOM a domain name registry. Customers can purchase domain name via WILD APPLE DESIGN GROUP and select to have our team manage the billing. Customers can also request to self-service their domain names where a sub-account is created and any customer domain names are pushed to an account where the customer has full access,. In this setup the customer also claims responsible for the billing. If your domain name is registered with WILD APPLE DESIGN GROUP or a third party domain registry the customer is responsible for the renewal and upkeep of paying for the service. If a customer forgets to renew their domain name WILD APPLE DESIGN GROUP is not responsible for any downtime of web services that may occur or additional fees to rescue a delinquent domain from a registry-hold or what they call the redemption grace period. Generally speaking, once a domain expires, the owner has up to 75 days to renew it, and the costs associated with a renewal usually increases as the domain moves from Hold (Registrar-Hold).


Email Services
WILD APPLE DESIGN GROUP does not include email services with our hosting packages. However, we are happy to assist you with setting up third-party, cloud-based email services. Alternatively, you are welcome to use any email provider of your choice.


DNS Services

We offer DNS services through ENOM for any domains purchased from us. However,  we also offer Cloudflare for an additional fee, or you can use any other third-party DNS provider of your choice.


Google Analytics
Google Analytics is a free service from Google that offers in-depth insights into your website’s overall traffic, audience, and user behavior. In most cases, WILD APPLE DESIGN GROUP will handle the initial setup and integrate Google Analytics with your website. Custom reporting is available for an additional fee or as part of an ongoing service contract—just let us know if you’re interested.


Please keep in mind that Google Analytics is a third-party solution, and its features and software options may change over time. We do not automatically enable new features as they become available unless specifically requested by you.


Access and Use
WILD APPLE DESIGN GROUP is not responsible to Customer for unauthorized access to Customer Data or unauthorized use of the Services through authorized or unauthorized access provided by Customer to third parties. Customer is responsible for the use of the Services by any of Customer’s employees, affiliates, officers, directors, shareholders, agents or representatives, or any other third party given access to the Service, and any third party who gains access to Customer Data or Services as a result of Customer’s failure to use reasonable security precautions.


HIPAA
In short don’t collect sensitive information that includes Protected Health Information ("PHI"), as that term is defined Title II, Subtitle F of the Health Insurance Portability and Accountability Act of 1996, as amended. In other words if the customer needs to store PHI data (social security numbers, health records etc.), Customer and WILD APPLE DESIGN GROUP shall enter into an agreement into a Business Associate Agreement ("BAA") to provision a HIPAA compliant hosted service. The BAA is a legal contract that describes how the business associate adheres to HIPAA.


Courtesy Services
All services such as daily backup, ssl security certificates, core software updates to the platform or apps that we develop customer websites are managed by WILD APPLE DESIGN GROUP.


Changes to (TOS)
WILD APPLE DESIGN GROUP reserves the right to revise, alter and update the above (TOS) without notice at any time at its sole discretion and can apply any and all changes and updates retroactively.
