Web Site Design & Development Terms & Conditions

The following terms and conditions apply to all website development / design services provided by WILD APPLE DESIGN GROUP to the CLIENT.


Acceptance

A signed acceptance of these terms and conditions is not required for them to be binding. By accepting a quote from WILD APPLE DESIGN GROUP, the CLIENT is deemed to have reviewed and fully accepted these terms and conditions.


Charges

Charges for services to be provided by WILD APPLE DESIGN GROUP are defined in the project quotation that the CLIENT receives either by e-mail or hardcopy. Quotations are valid for a period of 30 days. WILD APPLE DESIGN GROUP reserves the right to alter or decline to provide a quotation after expiry of the 30 days.


Unless agreed otherwise with the CLIENT, all website design services require an advance payment before the work is supplied to the CLIENT for review. The exact deposit will be included in the project quotation and determined based on the scope and timeframe of work performed.


WILD APPLE DESIGN GROUP accepts the following credit cards VISA, MASTERCARD, and AMEX. Credit cards payment can be made online from our secure online billing system or over the phone by calling 833-413-WILD (9453). We also accept checks payable to WILD APPLE DESIGN GROUP and sent to PO Box 72, Hampden, MA 01036.


Design Review & Acceptance

WILD APPLE DESIGN GROUP will provide the CLIENT with an opportunity to review the proposed design concepts. The exact number of proof concepts and revisions will be specified in the project quotation. Once the CLIENT has signed off on the proof concepts, they will be deemed accepted and work will begin on the next phase of the project.


Turnaround Time

WILD APPLE DESIGN GROUP will launch or deliver the CLIENT’s website by the date specified in the project proposal, or by another mutually agreed-upon date, unless a delay is specifically requested by the CLIENT and approved by WILD APPLE DESIGN GROUP.


To meet the agreed completion date, the CLIENT must provide all necessary content—including images, documents, data files, and other relevant digital materials—within the established timeframe. If delays are anticipated, WILD APPLE DESIGN GROUP will update the project timeline accordingly, and both parties will be required to approve the revised dates to ensure clear communication and avoid misunderstandings.


Failure to Provide Required Website Content

To maintain efficiency, WILD APPLE DESIGN GROUP schedules work to meet project deadlines and may need to decline or reschedule other commitments to honor these timelines. If we are unable to proceed with your website due to missing information not provided within the agreed timeframe, and this causes a delay, we reserve the right to apply a surcharge to reactivate your account.


If you have agreed to supply the necessary materials but fail to do so within 90 days of the project start date, we reserve the right to close the project and require immediate payment of any outstanding balance. Please ensure you are ready to proceed before giving us approval to begin your project.


Submitting Content

Please provide text content as a Microsoft Word document, Google Doc, PDF, or a similar file format. Each page in your document should correspond to a specific page on your website and use the same titles as those agreed upon for your site. If you need clarification on how to organize your content, please contact us. Note that any content not provided in a copy-and-paste-friendly format, or that requires additional typesetting, may incur extra charges.


For larger files that are too large to email such as hi-res images, videos, audio files etc., WILD APPLE DESIGN GROUP is happy to make accommodations using popular cloud based services such as Google Drive.


Accuracy of Site Content

The CLIENT is responsible for ensuring the accuracy of all information provided for publication on the website, including checking for typos and other errors. This responsibility also applies when WILD APPLE DESIGN GROUP is asked to transfer content from an existing website to a new one. While we make every effort to review the information we migrate, our staff cannot verify its accuracy unless specifically directed by the CLIENT.


Web Browsers

WILD APPLE DESIGN GROUP designs websites in accordance with current web standards established by the W3C, ensuring compatibility with the most widely used modern browsers, such as Google Chrome, Mozilla Firefox, Microsoft Edge, and Safari. While we strive for broad accessibility across desktop, mobile, and tablet devices, we cannot guarantee perfect functionality on every browser, operating system, or device combination.


WILD APPLE DESIGN GROUP is not responsible for website display issues that arise from browser or device updates released after the website has been completed and delivered to the CLIENT. If updates or modifications are required to maintain compatibility with new browser versions or technologies, WILD APPLE DESIGN GROUP reserves the right to provide a separate quote for this additional work.


Third Party Widgets / Add-ons

WILD APPLE DESIGN GROUP develops websites using current web standards to ensure compatibility with widely used browsers and devices. We create custom widgets and may also integrate widgets from the app store to enhance website functionality. However, the inclusion of any widget—whether custom-built or third-party—requires proper compatibility testing before deployment. Please note that not all widgets are guaranteed to work seamlessly with every website, and additional testing or adjustments may be necessary to ensure reliable performance.


Technology Assurance

The Technology Assurance Program (TAP) is a service level agreement (SLA) that ensures your website’s content management software is continuously maintained and optimized. As new technologies emerge, multiple updates to the core CMS and its add-ons are released throughout the year. With TAP, your enterprise CMS will be automatically updated, proactively maintained, and monitored for a fixed flat rate. Key benefits include:


  • Automatic installation of security patches
  • Ongoing review of add-on performance, with replacement of any unsupported or deprecated add-ons
  • Regular system and database maintenance to keep your site operating at peak performance
  • Continuous access to new features, ensuring your website remains current and secure


Payment

WILD APPLE DESIGN GROUP will issue invoices upon project completion but prior to publishing the live website, unless alternative payment terms have been specified in the project proposal. Invoices are typically sent via email through our online billing system to one or more designated recipients; however, the CLIENT may request hard copy invoices if preferred. Payment is due upon receipt. Accounts unpaid after forty-five (45) days from the invoice date will incur a service charge of 1.5% of the total outstanding amount.


Additional Expenses

Examples of additional expenses may include, but are not limited to, the purchase of special fonts, stock photography, or the setup of third-party services not specified in the project proposal. This also covers any extra changes, revisions to the design, or coding adjustments that fall outside the original scope of the project proposal.


Termination

Termination of services by the CLIENT must be submitted in writing; email notification is sufficient and will be effective upon receipt. If the CLIENT chooses to move their website to another provider, a one-time service fee of $500 will be charged to cover the packaging of website files, database, provision of relevant account credentials for third-party services, necessary communications, and the deactivation and packaging of all web services for transfer to the CLIENT.


For security reasons, WILD APPLE DESIGN GROUP does not offer a self-service hosting control panel. The CLIENT is responsible for coordinating the transition with their new web host or developer. Upon request, WILD APPLE DESIGN GROUP can assist with the migration of web services at an hourly rate.


Ownership

The CLIENT retains full ownership of their website and its content, as well as related services such as domain names or third-party services that WILD APPLE DESIGN GROUP may help set up on the CLIENT’s behalf. If the CLIENT chooses to terminate services with WILD APPLE DESIGN GROUP, they will be given sufficient time to back up their files and retrieve all website content.
